I recently got the 12.9" model.
The live-action video sample often fails to maintain 120fps. It usually begins at what looks like 24-30fps before switching to ~60fps 2 or 3 seconds in. Sometimes after reaching ~60fps it will rapidly increase frame rate until it gets to 120fps. The Battlefield gameplay footage, however, almost always runs at 120fps.
Also, Blur Busters frequently refreshes at less than 120Hz.

I failed to mention the video playback issues only happen when viewed in fullscreen. When watching them in the normal/windowed mode they both seem to always play at a stable 120fps.
